Ruto Wants to Arrest Me! Fred Matiang'i Claims

Former Interior Cabinet Secretary Fred Matiangi has moved to the High Court seeking anticipatory bail over an alleged looming arrest.

Matiang’i, in his application, argues that the Monday night raid of his Karen home is a political witch-hunt by President William Ruto’s government.

[The Inspector-General of Police Japheth Kooome says no such raid happened.]

According to Dr Matiang'i, confidential sources have informed him that he is to be arrested by the Ethics and Anti-Corruption Commission (EACC) and will be charged with abuse of office.

“Through a confidential source, I was reliably informed that the Ethics and Anti-Corruption Commission had also received instructions between February 6-9, 2023 to open a criminal file and charge me with trumped-up charges of abuse of office,” Matiang’i avers.

Matiang'i, who was a powerful Cabinet Secretary in President Uhuru Kenyatta’s administration, laments that the current government first withdrew his security before a contingent of police officers raided the home.

He claims that the officers attached to him were withdrawn a day after he spoke at Prof George Magoha’s home.

“The second respondent (Inspector General of Police Japheth Koome) has already demonstrated malicious intent and a clear disregard for the rule of law by abusing due process as evidenced by the reduction and withdrawal of the security officers assigned to the Applicant, thereby exposing him to harm despite the sensitive nature of his last post as cabinet secretary,” states Dr Matiang’i.

According to him, the timing of the raid and alleged looming arrest is meant to ensure that he does not attend his former colleague’s funeral.

“The applicant is aware that his woes got worse when he gave a speech at the home of the late Prof Magoha where he shared the lessons on public service that he had learned from the deceased. His security was withdrawn the next day and the impending arrest is part of the scheme to harass and silence him forever,” Matiangi’s application filed by lawyer Danstan Omari reads in part.

In his supporting affidavit, Matiang'i swears that during his tenure as a cabinet secretary, he has never had any unanswered audit queries.

“I have never been arrested or charged in any court for any offence in relation to the exercise of my duties in the various dockets that I headed,” he claims.

According to Matiang'i, this is out of ulterior political motives on trumped-up charges.

He alleges that the plot to arrest him was discussed and formulated on January 30, 2023, at the sidelines of the 16th Annual General Meeting of the Africa Prosecutors’ Association (APA) held at Mombasa.

Matiang’i claims that the police abandoned the idea when the media showed up.

He continues: “ True to their words, on the afternoon of the 9th February 2023, my family home in Karen was raided, surrounded, and cordoned off by police officers who were seeking to arrest me. The police officers barricaded the entry to my house and only retreated after the media and my Advocates arrived and the story of my impending arrest went viral on social media platforms.”

The former CS claims that informers have told him that the Police Ward Commander for Karen Police station had been given express instructions to provide support to the team that had been sent to arrest him.

At the same time, he states that he has never been summoned or a warrant of arrest issued against him.

“I am of the firm belief that the powers of arrest of the respondents and the Kenya Police are being abused and maliciously misused to harass, intimidate and oppress me and my former cabinet colleagues and His Excellency, the former president; so as to achieve extraneous political purposes unconnected with upholding the law,” he says.

Matiang’I has sued Director of Criminal Investigations (DCI) boss Amin Mohamed, Koome, Director of Public Prosecution Noordin Haji, Ethics and Anti Corruption Commission (EACC),  Independent Police Oversight Authority (IPOA) and National Police Service Commission (NPSC).

He has roped in Kenya National Commission on Human Rights (KNHCR) and the Law Society of Kenya (LSK).

Matiang'i is the immediate former Cabinet Secretary, Ministry of Interior, and Coordination of the National Government.

He has also served as the CS for Information, Communication and Technology (ICT), Lands and Physical Planning, and the Ministry of Education.

At the same time, he was also the Chairperson of the National Development Implementation and Communication Cabinet Committee.

Former Nairobi Governor Mike Sonko is expected to be arraigned at the Kiambu Law Court on Tuesday morning.

Sonko spent the night at the Muthaiga Police Station after he was grilled at the Directorate of Criminal Investigations the previous day.

This after his confession that he participated and orchestrated the 2017 post-election skirmishes in Nairobi.

Reports however indicate that Sonko could be charged with incitement to violence in Buruburu estate, Nairobi that led to destruction of property in 2019.

It is also believed that he will be charged alongside five other suspects accused of being his accomplices.

Sonko presented himself at the DCI headquarters at around 4pm on Monday.

This was a week after Interior Ministry Principal Secretary Karanja Kibicho lodged a complaint, accusing the former Governor of defamation.

Kibicho in his submission, said Sonko had admitted to committing a criminal offense and ought to face the law like any other Kenyan.

Sonko had been dealt a blow after a court declined his application to stop his grilling by the DCI.

In late January, PS Kibicho said he has had enough of former Nairobi Governor Mike Sonko’s attempts to assassinate his character.

His statement came days after Sonko sensationally claimed that he and others in the “Deep State” stage-managed destruction of vehicles to ruin its public image.

Kibicho stated that the burden of proof now rests on Sonko’s shoulders further urging the DCI to ensure he gets justice and is vindicated from the claims.

“I’ve seen some insinuation that, after Sonko made the wild allegations he did yesterday, I was summoned by DCI. To just clear the air, it is me initiating the process of getting my rights as a Kenyan and I walked to DCI to record a statement against Sonko because he needs to come on the table and provide evidence on the criminality he is alleging we committed with him,” said Kibicho.

“I am PS Interior as well, and I expect people who have run out of ideas, when they have problems, they will kind of blame me. And I will as a person check whether there is criminality in the blame or not.”

The Nairobi Governor by-election has been suspended pending determination of a petition filed by impeached county boss Mike Sonko.

High Court Judge Antony Mrima, in a ruling delivered on Monday, said Governor Sonko as well as the Nairobi County Assembly presented important arguments which he certified as urgent hence it was necessary to halt the by-election process and hear them first.

Nairobi County Assembly lawyer Ndegwa Njiru and Sonko’s legal team both expressed satisfaction at the ruling, further stating that the matter should be heard by more than one judge.

Judge Mrima will now issue a ruling on whether the matter will be heard by a bench on January 14, 2020.

Lawyer Ndegwa also stated that Sonko had nominated Ann Kananu to be his deputy governor hence arguing that should the Kenyan citizen who went to court to oppose the nomination drop the case, then Kananu should be sworn in as the new Nairobi Governor.

The Independent Electoral and Boundaries Commission (IEBC) last month set February 18, 2021 as the date for the by-election to replace Mike Sonko as Nairobi Governor following his impeachment.

IEBC Chairperson Wafula Chebukati, in a gazette notice, directed political parties intending to participate in the by-election to submit the names of the persons contesting in their party primaries.

Chebukati also directed political parties intending to present candidates in the election through direct nominations to submit the list of persons nominated on or before Monday, January 11, 2021.

“A public officer who intends to contest in the by-election shall resign from public office within seven (7) days of the declaration of the vacancy,” read the notice.

“The Commission shall publish, in the Gazette, the names of the persons contesting in a party primary and the date of the party primary within seven (7) days of receipt of the names of the candidates.”

The days for the nomination of political party candidates and independent candidates for the by-election were set on Monday, January 18 and Tuesday, January 19, 2021.

Kieni Member of Parliament Kanini Kega has dared Deputy President William Ruto to leave the Jubilee party if he feels it is too small for him.

The salvo of verbal attacks comes just days after the United Democratic Alliance was gazetted with a wheelbarrow as the party symbol.

Critics argued that the party had been formed by Ruto allies who lost control of the Jubilee party after members in key house positions were de-whipped in a political purge.

Speaking in Kieni, Kega said that it is hypocritical of the DP to still enjoy the perks of his office which are granted under the Jubilee party while promoting the activities of another party through his allies.

He demanded that Ruto tenders his resignation so that he can direct his energies on his 2022 campaign machine.

While comparing political parties to religion, Kega said that while most Christians profess allegiance to one doctrine, the deputy president was posing as a Pentecostal in the morning and a Catholic in the afternoon.

The MP noted that while it is okay for politicians to re-align ahead of the 2022 showdown, the formation and promotion of a political party by Ruto allies was indication that they had severed ties with Jubilee.

He also urged the registrar of political parties to take action, explaining that it is illegal to belong to two parties.
